Grandparent Rights

Grandparents tend to have special bonds with their grandchildren.  Unfortunately, grandparents are sometimes prevented from spending time with their grandchildren, often because of a divorce, death, addiction, deployment, or incarceration.

If this happens in your family, WV Legal can help petition the court to order visitation between the loving grandparents and their grandchildren. Our goal will be to demonstrate to the court that it is in the best interests of the children to grant the grandparents visitation with the children.

Sadly, more and more often these days, grandparents have to step in to protect their grandchildren from their own parents.  This is almost always because the parents are unfit due to a drug problem.  In these cases, WV Legal can often help grandparents obtain legal guardianship of their grandchildren. 

When a grandparent becomes a legal guardian, they become responsible for the everyday care of their grandchildren, making decisions about medical care, schooling, and finances.  In some of these instances, the parents are required to pay child support to the grandparents.
